1. Acceptance of Terms

By accessing and using CheapAPI.dev ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CheapAPI.dev is an AI API pricing comparison tool that allows users to compare pricing across 100+ AI models from various providers. The Service includes:

• Free tier — access to basic model comparison data for popular models
• Pro tier — access to 100+ model prices, advanced filters, cost calculator, price drop alerts, and data export

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any security breach or unauthorized use of your account.

4. Subscription and Payment

The Pro plan is priced at $5.00 USD per month. By subscribing to the Pro plan, you agree to the following:

• Billing — Your subscription is billed monthly in advance. Payment is processed through Creem, our third-party payment processor.
• Auto-renewal — Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
• Cancellation — You may cancel your subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.
• Price changes — We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• Payment processing — All payments are processed by Creem. Creem's terms of service apply to payment transactions. We do not store your credit card information on our servers.

5. Acceptable Use

You agree not to use the Service in any way that:

• Violates any applicable laws or regulations
• Infringes upon the rights of others
• Attempts to gain unauthorized access to any part of the Service
• Uses automated means (bots, scrapers, etc.) to access or extract data from the Service beyond the functionality we provide
• Redistributes, republishes, or resells our data without explicit written permission
• Interferes with or disrupts the Service or servers connected to the Service

6. Intellectual Property

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of CheapAPI.dev and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

The pricing data displayed on the Service is sourced from official provider documentation and is presented for informational purposes. Individual model names, provider names, and trademarks belong to their respective owners.

7. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. CheapAPI.dev makes no warranties, expressed or implied, and hereby disclaims all warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive to provide accurate and up-to-date pricing information, we do not guarantee that the pricing data on the Service is complete, current, or error-free. API providers may change their pricing at any time without notice to us. You should always verify pricing directly with the provider before making purchasing decisions.

CheapAPI.dev does not warrant that: (a) the Service will function uninterrupted, secure, or error-free; (b) the results obtained from the use of the Service will be accurate or reliable; (c) the quality of any products, services, information, or other material purchased or obtained through the Service will meet your expectations.

8. Limitation of Liability

In no event shall CheapAPI.dev, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

9. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, including the availability of any feature, database, or content, with reasonable notice to users when possible. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which CheapAPI.dev operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
